Terms of Service

1. Acceptance of Terms

By accessing this website or renting a vehicle from Manila Carnavan Rent A Car Co. (“Manila Carnavan”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms apply to all visitors, users, and customers of Manila Carnavan Rent A Car Co., including those who access our website or rent vehicles from our fleet.

2. Rental Eligibility

To rent a vehicle from Manila Carnavan, you must meet the following requirements:

• Be at least 21 years of age (25 years for luxury vehicles).

• Hold a valid driver's license issued in the Philippines or an International Driving Permit (IDP) if you are a foreign national.

• Present a valid government-issued photo ID (passport, national ID, or equivalent).

• Provide a valid credit or debit card in your name for the security deposit.

We reserve the right to refuse rental to any individual who does not meet these requirements or who we reasonably believe poses a risk to the safety of our vehicles or other road users.

3. Reservations and Payments

Reservations may be made through our website, by phone, or in person at our office. All reservations are subject to vehicle availability.

A security deposit is required at the time of vehicle pick-up. The deposit amount varies by vehicle category and will be communicated at the time of booking. The deposit will be refunded upon return of the vehicle in satisfactory condition.

Rental rates are quoted in Philippine Pesos (PHP) and are inclusive of applicable taxes unless otherwise stated. Rates do not include fuel, toll fees, parking fees, or any fines incurred during the rental period.

4. Cancellations and Modifications

Cancellations made more than 48 hours before the scheduled pick-up time will receive a full refund of any prepaid amounts.

Cancellations made within 48 hours of the scheduled pick-up time may be subject to a cancellation fee equivalent to one (1) day's rental rate.

No-shows (failure to pick up the vehicle without prior notice) will forfeit any prepaid amounts.

Reservation modifications are subject to vehicle availability and may result in a rate adjustment.

5. Vehicle Use and Restrictions

Rented vehicles may only be operated by the authorized driver(s) listed on the rental agreement. Allowing an unauthorized person to drive the vehicle is a breach of these terms.

Vehicles must not be used for:

• Any illegal purpose or in violation of any applicable law.

• Off-road driving or on unpaved roads unless the vehicle is specifically designated for such use.

• Transporting hazardous materials.

• Sub-letting or re-renting to any third party.

• Racing, speed testing, or any competitive event.

Vehicles must not be taken outside the Philippines without prior written consent from Manila Carnavan.

6. Insurance and Liability

All vehicles are covered by third-party liability insurance as required by Philippine law. Optional Collision Damage Waiver (CDW) coverage is available for an additional daily fee.

The renter is responsible for any damage to the vehicle not covered by insurance, including but not limited to: damage caused by negligence, violation of these terms, or driving under the influence of alcohol or drugs.

Manila Carnavan shall not be liable for any loss, damage, or injury to the renter or any third party arising from the use of the rented vehicle beyond what is covered by the applicable insurance policy.

7. Vehicle Return

Vehicles must be returned to the agreed location at the agreed time in the same condition as received, with the same fuel level.

Late returns will be charged at the applicable hourly or daily rate. A grace period of one (1) hour is provided; returns beyond this grace period will be charged for an additional full day.

Vehicles returned with less fuel than at pick-up will be subject to a refueling charge plus a service fee.

Upon return, Manila Carnavan will inspect the vehicle. Any damage not noted on the original rental agreement will be charged to the renter.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection and use of your personal information as described in our Privacy Policy.

9. Changes to Terms

Manila Carnavan reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the new terms.

We encourage you to review these terms periodically to stay informed of any updates.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Manila, Philippines.
